Tivoq is a video chat platform that enables topic-driven conversations in "spheres" with real-time 1-on-1 video chats, spectator viewing, and content creation features.

2. Eligibility

You must be at least 18 years old to use Tivoq. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Gem Purchases & Virtual Currency

4.1 Purchase Terms

• Gems can be purchased through our platform using real currency
• All Gem purchases are final and non-refundable
• Tivoq reserves the right to modify Gem pricing at any time
• Gems have no value outside of Tivoq and cannot be transferred to third parties

4.2 Gem Usage

• Gems can be used to tip hosts, unlock content, and access premium features
• Earned Gems (from tips and referrals) may be cashed out per our Creator Agreement
• Purchased Gems are for personal use and are non-transferable

5. Subscription Services

5.1 Plans

We offer various subscription plans including Host Pro, Ad-Free Premium, and Pro Bundle. Details and pricing are available on our pricing page.

5.2 Billing

• Subscriptions are billed on a recurring basis (monthly or yearly)
• You authorize us to charge your payment method automatically
• Prices may change with 30 days' notice

5.3 Cancellation & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• All subscription charges are final and non-refundable, except where required by law
• No refunds or credits for partial billing periods
• No refunds for Gem purchases

6. Content Ownership & Licenses

6.1 Your Content

You retain ownership of your likeness, voice, and original content shared on Tivoq. By using our Service, you grant us a limited license to:

• Store and display your content on the platform
• Create and store transcripts for SEO and search purposes
• Use anonymized data for platform improvement

6.2 Recordings

• Free users: Recordings stored for 30 days
• Host Pro users: Recordings stored permanently unless deleted
• You may download your recordings at any time

6.3 Platform Content

Tivoq and its licensors own all rights to the platform, including trademarks, logos, and software. You may not copy, modify, or distribute our content without permission.

7. Prohibited Conduct

You agree not to:

• Violate any laws or regulations
• Post content prohibited by our Community Guidelines
• Harass, threaten, or harm other users
• Attempt to hack, exploit, or disrupt the platform
• Create fake accounts or misrepresent your identity
• Use bots or automated systems without authorization
• Circumvent any security measures or access restrictions

8. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination:

• Your access to the Service will be revoked
• Any unused purchased Gems will be forfeited
• Pending cashouts may be canceled at our discretion
• You may request your personal data per our Privacy Policy

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free operation
• That content will be preserved indefinitely
• Specific outcomes from using the platform
• The conduct of other users

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIVOQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

11. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if eligible.
